Copyright and Content Removal
How to report copyright infringement, intimate images shared without consent and other illegal content.
Last updated
In short
- Intimate images shared without consent, including AI-generated ones, are removed within 48 hours of a valid request, usually much sooner.
- Copyright owners can send a notice to [email protected]. We respond to valid DMCA notices and counter-notices.
- Anyone in the EU can report illegal content and we will tell you what we decided and why.
This summary is for convenience only. The full text below is what applies.
Most content on TalkKiwi is live and is not stored: video and voice calls are never recorded, and stranger chat text is deleted 30 minutes after a chat ends. Content that can stay on the Service includes profile photos, display names and bios, messages between friends (up to 90 days) and group room messages. This page explains how to ask us to remove content.
1. Intimate images shared without consent
If an intimate image or video of you, real or computer-generated (a “deepfake”), has been shared on TalkKiwi without your consent, email [email protected] with the subject “Non-consensual intimate image” and include:
- a description of the image and where it appears (for example the username, room or date), enough for us to find it;
- a brief statement that you are the person shown, or authorised to act for them, and that it was shared without consent;
- your name and a way to contact you, and your physical or electronic signature.
We will remove the image and make reasonable efforts to remove known identical copies within 48 hours of receiving a valid request, in line with the US TAKE IT DOWN Act, and we will ban the account that shared it. You do not need to send us the image itself. If you were under 18 in the image, see also our Child Safety Policy.
2. Copyright (DMCA)
We respect intellectual property rights and respond to notices under the US Digital Millennium Copyright Act (DMCA) and similar laws. To report infringement, send a written notice to our designated agent with:
- your physical or electronic signature;
- identification of the copyrighted work you say is infringed;
- identification of the infringing material and information reasonably sufficient for us to locate it;
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the owner, its agent or the law;
- a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for the owner.
Designated agent: TalkKiwi, Attn: Copyright Agent. Email: [email protected].
Counter-notice
If your content was removed and you believe it was a mistake or misidentification, you can send a counter-notice with: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address and telephone number; and your consent to the jurisdiction of the federal court for your district (or, outside the US, any judicial district in which we may be found) and to accept service from the person who sent the notice. We may restore the material in 10 to 14 business days unless the complainant tells us they have started court action.
Repeat infringers
We will close the accounts of users who repeatedly infringe copyright, in appropriate circumstances.
3. Other illegal content and EU notices
Under the EU Digital Services Act, anyone can notify us of content they consider illegal. Use the Report button in the Service, or email [email protected] with: why you consider the content illegal; where it is (username, room, date and time); your name and email (unless the report concerns child sexual abuse material); and a statement that the notice is accurate and complete in good faith.
We will confirm receipt, review the notice promptly, and tell you our decision and the ways to challenge it. If we restrict someone’s content or account, we give them a statement of reasons and they can appeal. We may stop processing notices from people who frequently submit manifestly unfounded ones.
4. Trademarks and impersonation
If someone is impersonating you or your brand, report the profile in the Service or email [email protected] with the username and proof that you are the person or rights holder concerned.
5. False notices
Knowingly sending a false notice or counter-notice may make you liable for damages. If you are unsure, consider getting legal advice first.
